摘要
能源法律体系应包括能源基本法和具体能源法两个组成部分,其中具体能源法又可划分为能源利用法、能源产业法和能源公用事业法。以此为参照对我国能源立法进行体系化评估,存在能源基本法缺失、能源产业法覆盖领域的欠缺以及能源公共事业法整体上立法层次偏低等问题。因此,已从对《能源法》进行合理定位、完善能源产业法的覆盖领域以及提升能源公用事业法立法层次等方面推动我国能源法律体系的发展完善。
Energy law system should include energy basic law and specific energy law.Specific law is composed of energy use law,energy industry law and energy public service law.To evaluate our country＇s energy law systematically according to this,there are many problems such as deficiency in energy basic law,deficiency in cover area of energy industry law and low legislation level of energy public service law on the general.Therefore,the development of the domestic energy law system should be promoted by positioning of＂energy law＂reasonably,enlarging the cover area of energy industry law and improving the legislation level of energy public service.
