Analysis of the Unknown Clause on the Bill of Lading

"不知条款"事关我国国际贸易与国际航运业的健康有序地发展的问题,是一种承运人旨在减免自己对托运人的承运责任,在签发提单时设置的条款,但是,人们对"不知条款"效力却缺乏充分的认识,存在诸多分歧,对我国国际贸易与国际航运业的健康有序发展带来了极大的影响,因此本文针对我国"不知条款"存在的问题提出了完善之因应对策。

The＂Unknown Clause＂is concerning the healthy development of both China＇s international trade and shipping industry;it＇s a kind of term set by the carriers while issuing bill of lading in order to avert or mitigate their responsibilities to the shipper.However,people lack of cognition of the effection of ＂Unknown Clause＂.There exist many divergences,which influence the development of China＇s international trade and marine shipping.Therefore,this article proposes the corresponding countermeasures to solve the problems in China.
