摘要
在新知识学的哲学背景下,费希特柏林时期的法权思想发生了重要变化,这主要体现在法权概念的演绎起点从自我变成上帝,从而使他的法权哲学呈现出浓厚的宗教特点。当然,这种神性的法权思想又与耶拿时期有着本质的关联。从费希特对柏林时期法权概念的规定谈起,进而述及这种法权概念的形成条件和实现途径以及国家在法权概念的实现中所起的关键作用。最后,对费希特法权思想作出评价,认为它上承奥古斯丁的神性政治,下启当代的德性政治,体现出非自由主义的特质。
Under the philosophical context of new Wissenschaftslehre,Fichte's concept of right at the period of Berlin has experienced significant changes,especially the start-point of his right concept's deduction from Self into God.therefore,his right philosophy takes up strong religious characteristics.This theological right thought,of course,is linked essentially to that at the period of Jena.This paper starts from a discussion about Fichte's concept of right at Berlin period,and then expounds this right concept's forming conditions and realization approaches as well as the key role of state in the realization process.Finally,this paper remarks Fichte's right thoughts,and points out that his thoughts inherit from Augustine's theological politics,bear on contemporary morality politics and reflect the non-liberal characteristics.
