论罗尔斯《万民法》中的人权观 被引量：1

摘要 人权的普世意义一直是全球正义关注的焦点,也是后者的基础。罗尔斯的《万民法》将全球正义的研究推向了一个新阶段,而《万民法》中的人权观也引发了诸多争议。概而言之,罗尔斯支持了一种具有普世意义的人权观,并以之作为万民法的基础。但由于罗尔斯注重程序正义,拒绝任何形式的人性理论,他的人权观缺乏完善的论证基础。而且,由于罗尔斯过多强调人权对于维护世界和平的功能,这使他的人权清单内容比较"薄",对合宜等级社会也比较宽容。理论上的这些特征引来了不少学者的批评。
