The Countermeasures of Economic Law for Changing the Economic Growth Style

发展应以物质增量为基础,我国在现阶段发展中出现的不平衡、不协调、不可持续的问题也就是在物质增量利益的配置上出了问题。转变经济发展方式来应对这些问题,意味着我们需要完善经济法以重新调整物质利益关系。经济法是反映劳动力个人所有制要求,确认、设定和保护劳动力自益权的一个现代法律部门。完善经济法,就需要将劳动力个人所有制以及保护劳动力权写入宪法,并将经济法与社会法、奖励法有机地结合起来,以更好地调整资本逐利、劳动取酬和管理增收三方主体之间的物质增量利益关系。这样,才能从保护劳动力自益权、保障发展公平的意义上,科学地开发我国丰富的劳动力资源,从而顺利完成经济发展方式的转变提供强有力的法制保障。

Development should be based on material increment,at the present stage,the development of our country lacks of balance,harmony and sustainable,it means that the distribution of the material increment has problems.Now,changing the economic growth style to solve these problems means to readjust the relationship of material benefits.Economic law is a legal department that reflect the need for the ownership of labor and can also affirm,set and protect the self-interest labor rights.If we want to improve the Economic law,we should write the ownership of labor and the protection of labor rights into the Constitution.Meanwhile,we can combine the Economic law with Social law and Encouragement law,it can adjust the relationship of material benefits among the investors,workers and administors.Then,we can protect the self-benefit labor rights and equity of development.As a result,we can offer strong legal protection for the change of economic growth style.
