摘要 节能减排技术创新和知识产权制度具有彼此互惠、共同生存、协同进展的共生关系。知识产权制度对节能减排技术创新发展具有保障功能,节能减排技术创新对知识产权的完善具有推动功能。劳动财产理论、社会契约公意理论、财产权功利主义理论,是节能减排技术创新和知识产权制度共生性的理论基础。为实现节能减排技术创新和知识产权制度的共生性关系,应转变政府职能,改善市场环境,完善节能减排技术知识产权质押等制度设计。 Energy saving and emission reduction technology innovation and intellectual property system has mutual benefit and common life,the symbiotic relationship between cooperative progress.Intellectual property system has security function to energy saving and emission reduction technology innovation and development,Energy saving and emission reduction technology innovation has promotion function to the perfection of intellectual property system.Theories about labor property theory,consensual social contract theory,property rights utilitarianism are theoretical basis of symbiosis between energy saving and emission reduction technology innovation and intellectual property system.To achieve symbiotic relationship between energy saving and emission reduction technology innovation and intellectual property system,we should transform the government function,improve the market environment,and perfect energy saving technology and other intellectual property pledge system design.
