刑事诉讼法之再修改:结合实际,与时俱进——以基层法院司法实践为视角

The Revision of Criminal Procedure Law:Keeping Pace with the Times——Being Based on the Grass-roots Court

为适应新时代刑事审判的需要,我国以刑法修正案方式八次对现行刑法予以修正,但是刑事诉讼法依然未予修改。基层法院在审理刑事案件的司法实践操作中遇到了一些困难和困惑,对刑事诉讼法的相关规定应当适应刑事实体法的修改与时俱进进行修改,如对刑诉法关于刑事附带民事诉讼的适用、简易、普通程序的适用以及检察机关的诉讼权限、抗诉、再审程序的规定等应作必要的修改。

In order to meet the needs of criminal trial in this new age,we have fixed Criminal law eight times by Criminal law amendments. But the Criminal procedure law hasn＇t been got relevant modification. Grassroots courts have confusion in some trial criminal cases. This paper discusses about how to modify the Criminal procedure law in four aspects.
