我国国际河流的争端解决之路

The Way of Settling Disputes Concerning International Rivers

随着水资源短缺、水质量不断恶化、全球气候变化、节能减排的要求越来越高,各国利用国际河流的竞争愈演愈烈,从而加剧了可能产生的分歧与争端。目前争端的解决主要采取国内私力救济和外交手段,但是单纯依靠友好的政治关系,不能实现国际河流的最佳利用,也不能避免跨界水纠纷的发生。国际河流不可分割的自然属性,跨国的政治属性,要求流域国之间通过合作才能实现对国际河流的科学管理和利用,综合利用国际合作手段、组织手段、条约手段、外交手段等才能谋得国际河流争端的解决。

The competition is becoming fierce among countries pertaining to harnessing international rivers because of water shortage,deterioration of water quality,global climate change and the requirements of energy-saving and pollution reduction.At present,the dispute is settled by means of domestic private relief and diplomatic way.But it is impossible to use the international rivers at its best and to avoid the occurrence of transnational water disputes as well.Because the international rivers bears the characteristics of nature attribute and transnational political attribute,it is necessary for the countries of drainage area to cooperate in order to realize the scientific management and reasonable harnessing of international rivers.Only through international cooperation,organization,agreement and diplomacy can the disputes settled.
