摘要
刑法修正案(八)已设立"危险驾驶罪",但危险驾驶机动车的行为尚未达到应受刑罚处罚程度;目前的法律手段能够达到预防、减少危险驾驶机动车行为,保护人民群众的生命、健康和财产安全的目的;没有充分的根据说明设立"危险驾驶罪"是民意,即使是民意,也未必是设立"危险驾驶罪"的充分理由;设立"危险驾驶罪"将大大增加社会成本,与我国现有刑法原则精神和现行刑法规定不协调。
The newly amended Criminal Law（Eight） has defined ＂Hazardous Driving＂ as a criminal offence,but the act of drunk driving itself does not necessarily result in a traffic accident so as to be convicted.The legal means before this amendment can serve the purpose of deterring people from drunk driving and protecting the life,health and property of human beings.There is not sufficient evidence that the new amendment is the result in response to the public call.Even if it is,it is far from justified.The new offence of hazardous driving is going to increase costs on the social resources and is not in line with the country＇s present judicial principles and the criminal law,and so makes it difficult to handle specific cases.
