美国联邦巡回上诉法院:已分离DNA分子是可专利主题,而相关基因序列比对分析方法不可专利 被引量:4

摘要 2011年7月29日,美国联邦巡回上诉法院对分子病理学协会等诉美国专利商標局等(Association for Molecular pathology,et al.V.U.S.Patent and Trademark Office,et al.)一案作出裁定,认为已分离DNA分子具有可专利性,可以申请专利保护。此项判决推翻了美国纽约南区地方法院一年前作出的一审裁定。
