Legal Protection and Legal Control Measures for the Development of Biotechnology Industry

由于生物技术具有两面性,我国对于生物技术产业发展的基本策略应是一方面加大法律保障,另一方面加强法律监控。法律保障的举措是:推进生物技术产业的保障性立法,政府扶持生物技术的研发,提供优惠的融资政策,调整财税立法。法律控制的举措是:加强生物技术产业的监控性立法,设置常设性的技术咨询机构,确立生物技术风险评价制度,加强对生物两用品及其相关设备的管控。

As biotechnology has a dual character, China＇s basic strategy for the development of biotechnology should be to increase the legal protection on the one hand, and strengthen the legal supervision and regulation on the other. Legal protective measures include： encouraging the protective legislation for biotechnology industry, increasing governmental support to the research and development of biotechnology, providing preferential financing policies and adjusting fiscal and tax laws. Legal control measures include： strengthening legislations for the supervision and control over biotechnology, establishing permanent advisory bodies of technological policies, introducing biotechnological risk assessment system, as well as intensifying control over biological products and related equipments.
