我国湿地保护地方立法评析

Review of China's Wetland Protection Legislations at Local Level

湿地具有重要的生态功能及多重价值,在国家层面的湿地专项立法尚未出台的大背景下,我国湿地保护的形势更加严峻。现阶段我国湿地立法的成果均是地方立法,一方面各省可以充分结合自身问题的特殊性,有的放矢地对症下药,顺应了湿地的地域性差异,同时许多有益的尝试、经验值得以后的湿地立法借鉴参考。然而没有国家权威立法的宏观指导,囿于社会发展和科技水平的局限,地方立法总体还处于初级阶段,概括了较为典型的一些不足之处并提出了相关完善建议。

Wetland is playing a very important role in regulating climate,protecting biodiversity and rare species.But the wetlands are decreasing seriously.Under the background of lacking of wetland protection legislation at the national level,it is urgent to protect the wetland resources of China.However,there＇re some wetland protection legislations at local level already.Although our country＇s wetland protection＇s legal research is just at the primary stage,there still have many advantages for our reference.Then,this article intends to put forward the beneficial proposals of improvement in wetland protection legislation by means of the analysis on the existing problems.
