从“奥运帆船案”看技术性事项不予审查原则

技术性事项不予审查是指体育仲裁机构在对某项体育纠纷进行审理时,对涉及比赛规则、赛场裁判的裁决结果等纯粹技术性的事项不予审查,除非证明该裁决程序违法,或者是在裁判武断及恶意的情况下做出的,该体育仲裁机构才具有管辖权。国际体育仲裁院奥运特别仲裁庭通过其所裁决的北京奥运帆船案,对"技术性事项不予审查"原则的应用做出了进一步说明。
