摘要
陈傅良主张立法时要预防与惩罚相结合,变法时要为民与趋利相一致,突出预防和功用,既继承了对我国古代德主刑辅、德政王道的法制传统,又反映了变法为民、经世致用的时代诉求,总体上呈现出"外王"、"事功"法制思想的特色。这也凸显了他的学术风格和学术取向,是一份珍贵的法制思想文化遗产。
Chen Fuliang advocated legislation should combine prevention and punishment,and reform should make people's interest consistent with benefits,focusing on prevention and function.This was both inheritance of benevolent king's legal traditions in ancient China and requirements of reform for the people and the statecraft in times.Generally it showed "bbenevolence" and "utilitarianism",which reflected his academic style as a precious cultural heritage of legal thought.
