中国少数民族文化权利宪法保障之缺失与完善

The Defects and Improvement of Constitutional Guarantees of Cultural Right of Minorities

从新中国宪法发展的历程来看,国家非常重视对少数民族文化权利的尊重、保护和实现。但现行宪法仍存在未将保障少数民族文化权利确认为原则,对少数民族文化权利范围确认过窄,同时,对国家尊重、保护和实现少数民族文化权利的义务规定过少,也缺乏对少数民族文化权利进行有效救济的途径等。因此,需要将保障少数民族文化权利确认为宪法原则,扩大少数民族文化权利的范围和国家尊重、保护和实现少数民族文化权利的义务范围,并完善违宪审查制度等。

From the history of the development of the constitution,our country attaches great importance to the recognition and protection of the cultural right of minorities.At present our constitution do not confirm the guarantees of the cultural right of minorities as a basic principle,the recognition of the scope of the cultural right of minorities is still too narrow,while the provisions of the duty of the national commitment to respect,protect and fulfill the cultural right of minorities is not only too little,but also the lack of the way to an effective remedy about the cultural right of minorities.Therefore,our constitution need confirm the guarantees of the cultural right of minorities as a basic principle,expand the scope of the cultural right of minorities and the duty of the state to respect,protect and fulfill the cultural right of minorities and establish constitutional review system.
