论国有土地使用权的收回——兼评《国有土地上房屋征收与补偿条例》第13条第3款

Study on Depriving the Use Right of the State-owned Land: Comments on the Paragraph 3, Article 13 of the Regulations of Housing Acquisition and Compensation on the State-owned Land

研究目的:对国有土地使用权收回以及《国有土地上房屋征收与补偿条例》的修改提出建议。研究方法:现象溯因法,综合分析法,文献资料法,法理分析法。研究结果:国有土地使用权收回的法治化建构应当准确定位其性质,严格规范其程序,同时建立完善的补偿机制。研究结论:《国有土地上房屋征收与补偿条例》应将调整范围扩大至所有土地,这样才能保障土地使用权人的合法权益,顺利推进房屋征收。

The purpose of this paper is to propose suggestion on amending the Regulations of Housing Acquisition and Compensation on the state-owned land. Research methods include the abduction of phenomena, the comprehensive analysis, the literature review, and the legality analysis. Research results showed that the nature of regulations should be defined accurately, and the procedure should be regulated strictly. Meanwhile the compensation mechanisms should be established. The conclusions were that the scope of the Regulations of Housing Acquisition and Compensation on the state-owned land should cover all the land, which was the basis for protecting the legal rights of the land-owners and the smooth implementation of the Regulations.
