Approaches to the Perfection of Law System with Chinese Characteristics in China Today

当代中国特色社会主义法律体系形成之后仍需不断完善。基于人的自然、社会与政治三性,产生了私法、公法与社会法三法。但是,科学的法律体系必须是逻辑自足的系统,除了立法体系外,一切法律规范的创制都应该纳入法律体系之中。评判法律体系的形成和完善与否的标准,不应仅仅从数量方面来考量,更要符合调控水准、逻辑关联、价值理念和外部适应等方面的质量要求。当代中国特色社会主义法律体系的完善之路在于:坚持系统的自洽性与动态性的一致;从"神"、"物"本位彻底转变到以人的全面自由发展的权利为本位;奉行重点倾斜性与均衡协调性的统一;实现法律规范与其他社会规范的融贯;达至全局性与区域性、全球化与地方化的协调。

The law system with Chinese characteristics in China today still needs a further perfection.The scientific law system must be a self-contained logic system.The standards of completion and perfection in the evaluation of law system should involve in the adjusting level,logic association,value idea,outer adaptations and so on.Now the approaches to the perfection of the law system with Chinese characteristics lie in the conformity of system and dynamics,free development of mankind,key inclination and balanced adjustment,unity of law regulations and other social regulations,and the achievement of regional and global adjustment with localization.
