摘要全球气候变暖给人类社会生活安排造成了巨大冲击。合作减排以应对气候变化成为国际气候谈判的核心议程。由于根本哈根气候大会取得的成果有限,全球气候谈判几乎陷入停滞状态,需要从新的视角思考减缓气候变化的政策问题。在人权成为普世价值的当今世界,基于国际人权法的性质探索国家在气候变化语境里应该承担的尊重、保护与实现人权的义务,从而构建起人权保护与应对气候变化互动关系的理想图景。 Global warming has impacted human social arrangement.Cooperation in mitigation of greenhouse gas has been a core agenda.Copenhagen Conference with limited results demonstrated a stalling of global climate negotiation.A new perspective need to be established to consider policy of mitigating global warming.Human right has been a universally recognized value.Based on the nature of international human rights law we studied the duty to respect,protect and fulfill human rights and construct an ideal picture of mutual interrelationship of human rights and climate change.
