On the Theory of Traditional Property Rights' Object Responding and Amending to Environmental Crisis

传统物权客体理论具有局限性。面对环境危机,其特定性和排他性理论应予相应修正,物权客体的范畴应进行相应扩展。环境资源作为物权客体,面临对物的生态价值的追求和对物的概念的理解两个困境;但由于环境具有成为物权客体所必须具备的有用性、特定性和可支配性特点,及具备成为物权客体所必需的可度量性,环境资源作为物权客体具有可行性。

The theory of traditional property rights＇object has limitations.In the face of environmental crisis,its specific and exclusive characteristics should be accordingly amended,and the object of property rights category should be accordingly extended.Environmental resources as the object of property rights faces two puzzledom：the pursuit of the ecological value of property and understanding of the concept of property.Environmental resources as the object of property rights is feasible,because the environment that is to become the object of property rights must be useful,specific and can be dominant characteristics,and may be necessary to measure.
