从保障人权原则角度谈有限政府的建立

On the Establishment of Limited Government——From the Principle of Protecting Human Rights

阐述了2004年我国宪法修正案明确将"国家尊重和保障人权"写入宪法,成为我国宪法的一项基本原则。论述了从保障人权思想到保障人权原则确立的历史进程。指出人权保障原则与有限政府之间存在密切的关系。在我国构建有限政府需要从设计科学的政府规模制度、定位合理的政府职能模式和构建分权的政府权力体制三个方面入手。

The article discussed that the principle of the State respecting and safeguarding human rights was written into the Constitution and became a basic principle in 2004.It discussed the establishment process from the thought of protecting human right to the principle of protecting human rights and presented the close relationship between the principles of protecting human rights to limited government.The government should be established from the three aspects of designing scientific size of government system,positioning reasonable model of government functions and building the power system of separating of powers.
