动漫产业是我国近年来积极扶持的重要文化产业。卡通角色的商品化是形成动漫产业价值链的最重要环节。基于卡通角色的产生和运用途径,各国将著作权法视为最重要的动漫产业保护手段。文章分析了我国对卡通角色商品化的法律保护现状,并对相关的保护条件,侵权性质及权利期限等问题提出了建议。

Comic and Animation is an important industry supported in China.Commercialization of cartoon role is the key step to build the Value Chain of Comic and Animation.Almost all the countries in the world use copyright law as the most important tool to protect Comic and Animation because of the creation and utilization way of cartoon role.This paper analyses the status of protection to Commercialization of cartoon role in China,and bring forwards advices on questions as protection conditions,nature of infringement and the time limit.
