A Discussion on the Unlisted Basic Legal Rights

文章通过分析宪法中的未列举基本权利的非真正未列举基本权利、半真正未列举基本权利、真正未列举基本权利,认为前者可通过现有宪法条文的解释而予以保护,而后两者之保护必须动用概括性基本权利条款。该种条款许多国家宪法均有所规定。未列举基本权利的认定与推导需要有一定的标准以及方法。

By analyzing the basic legal rights which are non-truly, semi-truly and truly unlisted in the Constitution, the article points out that only the non-truly unlisted ones are interpreted and protected by the Constitution, but the semi-truly and truly ones are protected only by some other nonspecific rights clauses. The semi and non-truly ones are stated in the Constitution of many countries, but still some criteria and methods need to be clarified to defining the unlisted basic legal rights.
