制度经济学视角下的农村建设用地使用权直接交易法律制度构建

On Construction of Legal System of Rural Land-use Rights' Direct Transaction from the Perspective of System Economics

我国农村建设用地使用权流转法律制度需要进行反思和修改,以提高农村建设用地使用权利用效率。基于法经济学的方法,研究发现,现行农村建设用地使用权有限流转法律制度成本巨大,效率低下。必须通过法律上承认和配套措施的建立来促进农村建设用地使用权制度的完善,从而提高农村建设用地制度的效率。

The purpose of this paper is to enhance the using efficiency of China＇s rural construction land use rights by considering and modifying China＇s relevant legal system.Based on the methods of Law and Economics,this research finds that the existing rural construction land tenure system is costly and inefficient.It is concluded that it is the only way by law qualification and supporting measures to promote the free flowing of the rural construction land-use rights.
