摘要 用益物权转让是我国经济领域之中的一个新问题,随着这一问题的出现和发展变化,需要有相应的法律制度进行规范和调整。用益物权作为一种财产权利应当由法律确认和保护,并在法律的框架下进行有效的行使。用益物权可以依法转让,其转让制度的形成和发展,有利于促进相关的经济活动。在土地承包经营权、建设用地使用权、宅基地使用权、地役权等财产权利的流转和交易过程中,相关法律制度的建立和完善将推进经济和社会的发展。 Turn to let is an economic realm of our country with the benefit real right in of a new problem,change along with emergence and developments of this problem,need to have the homologous law system to carry on the norm and adjustment.Being a kind of property right and should be confirm by the law and protect with the benefit real right,and carry on exercising effectively under the frame of the law.Using the benefit real right can turn to let by law,it turns the formation and developments of let the systems,being advantageous to promoting the related economic activities.In land contract for conduct power,construction with the property rights,such as an usage power,the house base usage power and a service power...etc.flow turn and trade process,the establishment of the related law system and perfect the development that will push forward the economy and society.
