摘要
在实证研究和文献比较的基础上,为了提升《女职工特殊保护条例》的品质,文中提出并论证了两种新的立法理念:其一是正视现行职业禁忌制度中的歧视性后果,将滞后性"保护"改为前瞻性"赋权",针对女性群体的个体差异分类规范,赋予无需特殊保护的女性进入男性垄断的高薪职业的选择权;其二是关注工作环境权和女职工的人格尊严,借鉴国外"防重于治"的经验,增设单位防治职场性骚扰的义务和法律责任,以满足现实需求,填补国家法律关于"反性骚扰雇主责任"的空白。
On the basis of empirical research and literature comparison,this paper has proposed and proved two kinds of legislative ideas in order to promote quality of Acts on the Special Protection for Female Workers.The first one is to face up to discriminatory effects among current professional taboo system,transform the lagged "protection" to the prospective "empowerment".In connection with the classification of women according to their uniqueness,it needs to empower women who don't need special protection to move into men dominated high salary professions.The second one is to focus on work environment rights and female workers' human dignity,increase institutions' obligation and liability to prevent sexual harassment in workplace following foreign countries' experience of "putting prevention over punishment" in order to meet the real needs and fill the legal gaps of "employers' liability to prevent sexual harassment".
