消防行政强制执行代履行制度研究

A Research on the Substituted Fulfillment Institution of Fire Prevention Related Administrative Enforcement

根据《消防法》和《消防监督检查规定》,结合公安消防机构的行政执法特点,针对代履行制度的定义及其法律关系进行分析论证,提出了符合公安消防机构行政执法特点的代履行实施程序。

In accordance with Fire Law and Supervising and Examining regulation of Fire Prevention,and based on the features of administrative implementation of fire prevention and aiming at analytic demonstration of the substituted fulfillment institution and its legal relations,this article advances an implementation procedure of substituted fulfillment fitting the features of administrative enforcement of law.
