我国法律人才培养模式的反思与创新——以法学实验实践教学改革为视角 被引量:24

Reflection and Innovation of Training Model of Legal Talents in China——From the Angle of Experiment and Practice Teaching Reformation of Law Science

摘要 改革开放以后,我国的法律人才培养有了长足的发展,法律人才培养以"专业细化的分别培养"模式为主,对满足我国的法律人才需要发挥过积极作用。但是,随着司法现代化进程的加快,社会对法律人才的需要也有了新的变化,原来的法律人才培养模式的弊端日益明显,包括:高等院校作为法律人才培养的基地,不同层次和类型的法学教育目标定位不清;忽视实践能力的培养;缺乏人文教育等。通过考察国外的法律人才培养模式,可以发现,国外比较注重知识、能力、素质三者的有机结合,教学方法丰富、灵活,重视职业道德和职业技能训练。我国的法律人才培养模式应当借鉴国外先进经验,结合我国实际,明确培养目标,改革课程体系,转变教学方式,完善评估体系。 After reforming and opening, the training of legal talents in our country has been developed rapidly with the main model of "training separately based on elaborate division of specialty", which has played a positive role to meet the need of legal talents in our country. However, with the quickening of modernization of justice, there are some new changes in social needs for legal talents and the disadvantages of original training model for legal talents become growingly clear. These disadvantages include that: unclear targets for different level and different type legal education in the base of training legal talents universities and colleges as, neglect of practice ability training, and lack of the humanity education. By examining the training model of legal talents in some foreign countries, it can be found that : they pay more attention to the integration of knowledge, ability and quality; their teaching methods are rich and flexible; and they attach importance to the training of professional ethics and profession skills. Therefore, we should refer to the experience of other countries, define training aim clearly, and reform course system, change teaching methods and perfect assessment system, according to oar country ' s situation.
