论网络诽谤犯罪的地域管辖

Territorial Jurisdiction over the Internet Defamation Crime

诽谤犯罪自从打上网络的特征之后,传统诽谤犯罪地域管辖连接点在网络诽谤独特的虚无空间中被突破。文章借鉴先进经验国家的立法、判例,基于对网络诽谤犯罪预备、实行和实行后三阶段具体分析,揭示了网络诽谤犯罪地与刑事地域管辖的联系,提出网络诽谤罪地域管辖连接点的确定标准是侵犯刑法法益原则。

Since the defamation crime through internet came into being,the junction point of territorial jurisdiction over the traditional defamation has been broken in the unique virtual space of network defamation.With the references of legislation and precedents in certain experienced countries,this paper,based on the analysis of three stages of preparation,implementation and post effectuation of network defamation crime,reveals the relationship between the defamation venue and territorial jurisdiction and points out that the norm to confirm the junction point of territorial jurisdiction is the interest principle of infringement criminal law.
