立法后正当性评价包括伦理评价和历史评价两个尺度。这两个评价尺度既相互统一,又相互对立,其对立统一的基础在于法的制度道德。法的制度道德兼具理想性与现实性、合目的性与合规律性,是沟通立法后正当性评价的尺度和标准的桥梁和纽带。法的制度道德可以进一步具体化为不同的价值标准,这些标准可用于检验立法和法律实施的正当与否。

Ethical appraisement and historical appraisement are two measures of justification in leg- islative meta- evalution. There are opposite and unified relationships between ethical appraisement and historical appraisement, which based on institutional moralities. Institutional moralities, which link the measures and strandards of justification in legislative meta- evalution, am not only ideal and realistic, but also correspond to purposes and principles of law. Institutional moralities should be embodied into dif- ferent standards of value, which can be used to evaluate the justification of legislation and legal imple- menting.
