论财产保险标的的转让及其法律适用

On Transfer and Law's Applications of Property Insurance Object

财产保险合同保险标的的转让对保险合同权利义务的转移造成的影响如何,各国法律的规定有所不同。我国2009年保险法在此问题上采用了与以往保险法不同的立法规定,其在审判实践中所带来的变化可想而知。但修改后的保险法对何谓保险标的的转让并未明确,其对保险法相关规定的适用必然会带来一些疑惑。从实务中的相关案例引发的问题出发,对保险利益、保险标的的转让以及保险标的转让对保险合同转移的影响进行了阐述,并结合新旧保险法的不同规定对实务中的保险标的转让及其对案件结果带来的不同影响进行了分析。

The transfer of insurance object in the property insurance contract has surely influenced the transfer of the rights and obliga- tions. The influence is various in different countries. The legislation for it in Chinese ＂Insurance Law＂ revised in 2009 is different from the older one and many changes have definitely taken place in practice. However, the revised ＂Insurance Law＂ does not clearly define the transfer of insurance object and it surely leads to some confusion with the application of some concerned regulations. On the base of practice, such problems are discussed as the insurance benefit, the transfer of insurance object and its influence. Combined with the different regulations in the new and old insurance law, the transfer and each others specific result have been analyzed.
