摘要
《欧盟数据库指令》在对数据库版权进行保护的同时,对数据库提出了特殊权利保护。特殊权利保护注重对投资者的经济利益保护。我国数据库发展尚属初级阶段,法律法规还不完善。论文通过评析欧盟数据库保护模式及我国现行法律下对图书馆数据库的保护,提出对我国数据库保护的立法建议。
Directive 96/9/EC protects the copyright of database and proposes to offer sui generis right-protection which protected and paid attention to the economic benefits of investors who made library database. The development of database in our country still belongs to primary stage and the laws and regulations are not consummate. By analyzing EU database protection mode and Chinese library database protection against the current laws, this paper gives some suggestions on the legislation of database protection of our country.
