Comparison of Eminent Domain Between China and the USA

国家征收是政府通过国家权力强制取得财产所有权的一项法律制度。美国联邦宪法修正案的"正当程序条款"确定了征收权的宪法渊源,其对征收权的限制体现在公共利益、正当程序以及公正补偿等三方面。美国的国家征收制度对我国征收制度的改革与立法完善具有一定的参考价值和借鉴意义。

Eminent domain is a legal system where property right is deprived by the government because of the government power. The due process of the federal Constitution is the resource of the eminent domain. The restrictions of the eminent domain are： public interest, due process and just compensation. This system has great influence on the law-making in China, especially on the Property Law in China and so on.
