马克思的权为民所赋思想及对我国法治建设的意义

Marx' s Thought on Rights Conferred by the People and Its Significance to China's Construction of the Rule of Law

权为民所赋是马克思所总结的巴黎公社的两大原则之一。100多年过去了,马克思所总结的巴黎公社的原则,正改变着世界,并成为民主法治最基本的原则。但在社会主义国家,权为民所赋原则却未能引起应有的重视。纪念巴黎公社的时候,往往强调它的无产阶级专政性,却忽略了巴黎公社的民主性原则,这不但不能正确认识巴黎公社的历史意义,也必将对社会主义民主和法治建设带来不应有的负面影响。

Rights conferred by the people is one of the two major principles of the Paris Commune summarized by the Marxism. 100 years later, the principles of the Paris Commune summarized by Marx is transforming the world and becomes the most basic principle of a democratic rule of law. But in the socialist countries, the principle of the right conferred by the people has failed to draw the attention it deserves. When commemorating the Paris Commune, we always emphasize its dictatorship of the proletariat while ignoring its democratic principles. It could not help us to understand the historical significance of the Paris Commune properly, and will have side effects on the construction of socialist democracy and the rule of law.
