对测谎结论证据能力的再思考

Restudying on the Admissibility of Evidence of Lie-detecting Conclusion

对测谎结论的证据能力一直存在"肯定说"、"否定说"与"有限肯定说"的争论。从测谎的科学原理及测谎结论的可靠性来看,测谎结论具有客观性。从测谎的方法和内容看,测谎并不能对证明案件事实发挥实质性的作用,不具备证据的关联性。而且从我国目前的法律规定中难以找到其合法性根据。因此,测谎结论不具备证据能力,只能作为侦查辅助手段发挥其应用价值。

There has always been a dispute on the admissibility of evidence of Lie-detecting Conclusion as ＂admissibility of evidence＂,＂non-admissibility of evidence＂ and ＂limited admissibility of evidence＂.From the view of scientific principles of Lie-detection and the reliability of the conclusions,Lie-detecting Conclusion has objectivity.From the method and content of lie-detection,the Lie-detecting Conclusion can not play a substantive role to prove the facts of the case,and do not have the relevance of evidence;and on the base of our current law is difficult to find its legitimacy basis.Therefore,the Lie-detecting Conclusion does not have the admissibility of evidence,only as investigative aids play its application.
