检察机关提起环境民事公益诉讼既是保护环境与资源,弥补环境行政执法不足的需要,也是维护弱势群体合法权益,完善诉讼制度的客观要求。构建检察机关环境民事公益诉讼制度,除在立法中赋予检察机关环境民事公益诉讼诉权,还需解决检察机关的诉讼权利和义务问题。

Environmental civil litigation by procuratorial organs can not only protect environment and resource,and make up for the lack of environmental administrative enforcement,but also protect the legitimate rights and interests of vulnerable groups and improve litigation system.The establishment for the system of environmental civil litigation by procuratorial organs should give the right of environmental civil litigation to the procuratorial organs and solve the problems of litigation rights and obligations for procuratorial organs.
