论我国司法活动中律师执业权利之构建——以律师的刑事辩护权为视角

On the Construction of Lawyer Professional Rights in China's Judicial Action ——In Terms of Lawyer's Defendant Rights in Criminal Suit

基于我国特定的历史文化传统与政治法律背景、司法领域内的腐败现象以及现行法律法规的不健全,目前我国司法活动中律师的执业权利,特别是刑事诉讼中律师的辩护权往往受到司法机关的忽视甚至侵犯。为合理构建我国司法活动中律师的执业权利,不仅需要司法机关转变观念,加大司法领域内的反腐败力度,更重要的是建立健全相关的法律制度,使司法活动中律师的执业权利能够正当行使。

Grounded on the special history and culture tradition and the background of politics and laws,the corruption in the judicial sphere,imperfection of the laws and regulations in effect,at present,the lawyer,s right in judicial action in China,especially the lawyer,s defendant rights in the criminal suit,have often been ignored,even infringed,by judicial organizations.In order to construct reasonably the lawyer＇s rights,not just our judicial organizations should transform their ideas to strengthen the struggle against corruption,but most important,relative legal system should be established and improved to make it possible for the proper practice of the professional rights of lawyers in judicial action.
