伦理难题的立法之道——一种可能的立法论证过程

Legislative Process of Ethical Problems

本文拟以论证理论为视界,将相关立法过程理解为一个论证的过程,尝试分析该论证可能具有的逻辑结构。针对立法论证过程,笔者以伦理学、政治哲学、立法学的划分为依据,区分不同层次的问题,划分出相应的论证单元,并在此基础上说明各个单元不同论证目标和方法。在文章的最后,笔者将以安乐死为例,综合阐述安乐死合法化问题可能的立法论证过程。

This article tries to analyze the logical structure from the perspective of the demonstration theory that the related legislative process will be understood as process of demonstration.Against this legislative demonstration process,the author distinguishes different levels of problems,marks out corresponding demonstration units and illustrates various demonstration objectives and methods of respective units based on the division of ethics,political philosophy and legislative science.Finally,the author comprehensively elaborates the possible legislative demonstration process of euthanasia legitimating by taking euthanasia as an example.
