On Origin and Development of Homestead Act——Solutions to Issues on Homestead System

家宅制是在美国和瑞士等国家实行了一百余年的制度。在保障自耕农的土地和住宅权益方面发挥了重要的历史作用。我国的宅基地制度在保障农民住宅权、稳定农村社会等方面与家宅法有着诸多相似之处,但在制度设计上过于粗疏。正在进行的宅基地制度改革可以借鉴家宅法进行制度重构。

The homestead system, which has practiced for over a century in America and Switzerland, did have historical significance in safeguarding the peasants’ land and their housing rights. Compared with such homestead system, although there are many similarities in our country’s homestead system with regard to safeguarding farmers’ housing rights and stabilizing the rural areas, there are still imperfection in our system design. Thus the system reconstruction and reform of our country’s homestead system can take the above-mentioned homestead act for reference.
