摘要
在俄罗斯刑法理论上,关于犯罪构成结构的争议性问题可以归结为三类:即犯罪构成应由哪些要件组成?通说的四要件犯罪构成中"要件"和"特征"的关系是什么?以及四要件应该怎样排列?在我国的犯罪构成理论研究中,也同样遇到了这些问题。
In Russian criminal law jurisprudence,the controversial issues on the constitution structure of crime can be classified into three categories as follows.Which requirements should the constitution of crime be composed of? What is the relation of 'requirements' and 'features' in the four requirements in constitution of crime according to the general theory? How about their respective order? The above mentioned issues also occurred in our nation's jurisprudence research on constitution of crime.
