在刑法信条学的构架下界定犯罪概念分为实质定义和形式定义两个层次。同时犯罪概念本身是一个动态的发展的体系性的；是社会性和法律性的统一；是立法者对刑法价值的中道权衡的结果；是形式性和实质性的统一。对犯罪概念的研究应立足于刑法信条学,结合刑事政策和刑法解释进行体系化的全面思考,借助刑法解释的作用,形成犯罪概念形式定义和实质定义的具体的紧密的联系,不可偏颇。

Crime,in criminal dogmatics,is defined into two aspects,one is substantial,the other formal. The definition of crime is a dynamically developing system.So the study of the definition of crime should be based on criminal dogmatics and by the aid of criminal explanation.
