In one country where practises written law system,judicial justice always turns to be conspicuous when legislation lags behind,which makes the criteria,contents and realization of judicial justice become more complicated.Particularly,in the realm of criminal rule of law which legally regards crime-punishment as its basic principle,it is greatly significant to realize almost complete justice under the condition of ensuring the respect and authority of written law.
