摘要
商家选择权是指商家相对于消费者所具有的自主选择商品或服务的权利。而且拥有在法律范围内自主选择有利于其经营的方式方法的权利。从商家与消费者之间法律关系的性质,以及合同法的禁止性规定,权利与义务的相对性三方面看,商家必然拥有选择权。同时商家对其选择权的使用也有严格的法律界定。
The trading firms have an advantage compared to the consumer, so we need the law to especially protect the consumers in weak tendency through legislation, and give consumers multiple rights including option.This article analyses rational of trading firms in option from three angles. We draw the conclusion, on the basis of these findings, that it is rational to define the meaning of the options of the trading firms, with regard to the specific conditions, and the trading firms should control the options.
