摘要
随着国际贸易的日益繁荣,应运而生的航运业全球化进程也在不断加快.船旗国的法律体系不同,造成各国对船舶、船员等要求也不尽相同.为使国际间的法律体系有利于航运业的公平竞争和健康发展,分析港口国监督的特点,对比船旗国监督存在的相对优势,充分肯定港口国监督的模式和效果,并建议在互相理解备忘录的框架下制订更多的新措施来履行港口国监督职责.
With the prosperity of international trade,the globalization of international shipping industry develops quickly,however,the different legal systems in different countries lead to the varied standards of ship's seaworthy condition and seafarers' competence,how to deal with this problem,which made the unformed standards of ships and seafarers in international scope so as to keep the fair play and healthy growing of the international shipping industry.According to this topic,the paper analyzes the characterizes of the port state control(PSC),and compares with the flag state control(FSC),the PSC has some advantages,and then the conclusion can be drown that the PSC model is a very effective approach to cope with this very topic,beside,much more new measures under the framework of the Memorandum of Understanding(MOU) should be created to perform the PSC activity.
