Delegation of ships' statutory certification by flag state

船舶法定证书发证是船旗国主管机关的职责.认可的组织,如船级社,代表主管机关行使部分或全部法定证书签发职能.该方式被世界上大部分国家所采纳,有关国际公约,如SOLAS74、MARPOL 73/78等,均对此做出了相关规定.针对主管机关如何授权,IMO还制定了一系列规则和指南.对认可组织授权作为法定证书发证主体,但并不意味着其能承担主管机关的所有义务.

Ship's statutory certification is the responsibility of the flag state administration.However,it is a prevailing practice that such statutory work is thoroughly or partly executed by the recognized organization such as classification societies acting on the behalf of the administration.Similar regulations can be examined in some international conventions,for instance,SOLAS74,MARPOL 73/78.IMO also has adopted relevant codes and guidelines relating to delegation in detail.Authorizing a recognized organization as the statutory certifying body does not mean the administration can delegate its responsibility.
