黑社会性质犯罪是一种十分复杂的犯罪现象，必须从犯罪学和刑法学两个角度进行研究。在犯罪学意义上，黑社会性质犯罪建立在典型的黑社会犯罪的概念与特征的基础之上，同时也具有自身的一些特点。在刑法学意义上，黑社会性质犯罪是指组织、领导、参加黑社会性质的犯罪组织，以及境外黑社会成员到我国境内发展成员的行为。
