摘要
劳动的非商品性和劳动力的商品性决定了关于劳务派遣的立法应坚持在管制的基础上有序的放松。但是,我国目前的劳务派遣缺乏基本的规制,存在用工规模大、滥用、行业准入低、无监管以及派遣劳动者权益易受损害等问题。导致这些问题的原因是多方面的,但根本原因在于相关立法价值定位的迷失和体系性制度的缺失。因此,我国应借鉴世界主要发达国家的经验,在劳务派遣的行业准入、监管、派遣劳动者权益保障以及责任追究等方面加强法律规制。
Non-commodity characteristic of labor and the commodity characteristic of labor force determine the legislation for labor dispatch should abide by the way to keep orderly flexibility based on regulation.The labor dispatch of China is lack of the governance with the problems as abused,low standards for admittance,flexible supervising and weak rights protection for dispatched workers.So we should borrow foreign experiences for reference to optimize our statues in following fields,such as the admittance,supervision,rights protection and the accountability system.
