特别权力关系理论的发展与高校学生的权益保护——从江西自考生维护“考试权”一案谈起

On the Development of Special Power Relation Theory and the Right Protection for College Students——By the case of a self-taught student's maintenance of "Examination Right"

2008年全国自考江西某民办高校在自己所在考点的考试中因学生欠交学费而将学生驱逐考场,一名女同学为维护自己的"考试权"将学校告上法庭。该案发生后引起社会各界高度关注。透过此案我们需要检讨对高校具有长期影响的特别权力关系理论,并思考在法治社会中如何更好地维护高校学生的合法权益。

In 2008, a private college in Jiangxi Province expeled the students owing its tuition from self- taught examination rooms. A girl students sued the college for maintaining her ＂Examination Right＂, which was paid high attention to by all walks of life. The ease promotes a review of special power relation theory in colleges and a reflection on how to maintain college students＇ legal rights in the present society.
