摘要
中国《反倾销条例》在确定正常价值时只是笼统地提到"正常贸易过程",并没有界定"正常贸易过程"或将低于成本销售和关联当事方之间的销售排除于"正常贸易过程"。而WTO和欧美在立法和实践中对"正常贸易过程"作了更详尽的规定。通过评析WTO《反倾销协定》及欧美的规定和做法,认为中国立法的缺失会增加调查机关确定倾销产品正常价值的难度和不确定性,导致调查程序缺乏可预见性和透明度,增加贸易争端。
Through the analysis on the WTO＇s Anti-dumping Agreement and regulations and practice in Europe and America,it is thought that China＇s deletion of regulation would increase the difficulty and uncertainty of investigation authorities＇ determining the normal value of dumping products,which leads to the foreseeability and transparency of investigation procedures and increases trade disputes.
