浅议集体林权制度改革若干法律问题

On the Legal Issues in the System of Collective Forest Tenure Reform

依据集体林权制度改革的有关政策以及我国物权法等法律,文章分析了集体林权制度改革中的林权的法律含义,梳理了现行有关法律制度与林权流转实践的冲突,论述了集体林权制度改革背景下,现行有关森林资源管理法律制度在调整林农利益与生态公益方面的缺陷,并提出改革森林采伐管理体制和加快森林资源生态效益立法的建议。

Based on the related policies in the reform of collective forest ownership and property law,this study analyzes the legal implications of the forest ownership in the reform and the conflicts between the existing legal system and the practices in transferring forest ownership.Meanwhile,it tentatively discusses the deficiencies embedded in balancing the forester＇s interest and the ecological welfare under the current legal systems of forest resources management in this reform background.Eventually,suggestions are proposed in reforming the system in managing forest harvesting and accelerating the legislation of ecological benefits of the forest resources.
