依法行政背景下引诱性执法的规制

The Governance of the Attractant Way of Law Enforcement under the Background of Government Administration in Accordance with the Law

行政机关滥用引诱性执法方式,使人们对此种执法方式颇有微辞。然而引诱性执法也有其良性价值,在一定范围和领域内,合理利用引诱性执法方式也是开展行政执法、惩治违法行为、实现执法为民的需要。在依法行政背景下,应从明确使用范围、规范执法行为、强化执法程序、加强执法救济、完善执法监督、建立执法方式使用审批等方面,对引诱性执法的使用进行规制。

Due to the frequent abuse of attractant way of law enforcement by the administration,people covertly criticize on it.However,it still has its positive value.It＇s the need of proceeding law enforcement,punishing offense and achieving enforcement for people to reasonably use the attractant way of law enforcement in a certain range and area.Based on legitimate administration,the use of attractant way of law enforcement should be standardized through the system construction by establishing the scope of use,standardizing law enforcement activities,strengthening law enforcement procedures,enhancing law enforcement assistance,improving law enforcement supervision,and establishing the system of approval by law enforcement.
